DESIGN AGREEMENT

We at Hankins & Associates, Inc. would like to thank you for allowing us the opportunity to prepare a preliminary conceptual kitchen design plan for you. The design retainer investment is based on a square footage fee of $7.00 per square foot. This measurement shall include the breakfast room and/or areas that can affect the overall kitchen design. Your design retainer has been calculated at _________________ Sq. Ft x $7.00 = $_________________. Fifty percent (50%) of the total design retainer amount is due at the time of signing this agreement ($_________________). If your kitchen is less than 108 Sq. Ft., the design fee minimum will be $750.00.

Step one is to prepare scaled plan-view drawings, where various design ideas and solutions are developed using trace overlays and/or CAD (computer aided drafting).

Step two, conducted at our studio, is to present you with various design concepts. At that time, it is our goal to determine a design direction which best suits your needs and which satisfy the established design criteria. During that meeting, "ballpark" project budgeting will be discussed based on the various selections made by you.

Step three is to complete the final design plans, together with a comprehensive project estimate proposal for your review and ultimate authorization to commence with the project. Design plan and elevations changes made by the client, once the "final" plans have been completed, may incur an additional charge of $75.00 per hour. No portion of these additional charges will be credited against the project costs. Your total design agreement provides for _________________ hours of staff time (based on Sq. Ft. x .11).

Whereas Hankins' may offer "ballpark" budget figures in advance of entering into a design retainer agreement, the client understands the essence of the word "ballpark" as presented herein. Actual and tangible figures cannot be provided until a design plan has been completed. The client also understands and acknowledges that Hankins' invests both time and resources in the preparation of any and all design plans, whether conceptual or otherwise. Therefore, it is understood that under no circumstance will the design retainer investment, in whole or in part, be refundable.

The design plans, together with any conceptual sketches, are, and will remain the property of Hankins & Associates, Inc. Design plans and/ or conceptual sketches will not be released unless the client has signed a letter of agreement committing to the project or the design fee has been paid "in full".

Hankins& Associates, Inc. will apply the full design fee investment as credit to a contracted kitchen within sixty days (60) of the type written proposal date. After such time and up to one calendar year, Hankins & Associates, Inc. will apply fifty-percent (50%) of the design fee investment as credit to the contract price as agreed upon.

Hankins & Associates, Inc., unless otherwise agreed, shall be provided the opportunity to photograph the project once complete. The photographs may be used for display and/or marketing purposes as determined by Hankins & Associates, Inc. At no time will Hankins release the name of the client, their address or phone, unless authorized by the client.
